GigSA Platform User Participation Agreement
  1. Article One: Definitions
    The following terms and phrases shall mean the indicated meanings alongside each term, unless explicitly stated otherwise or the context otherwise requires:
    1. Event Organizer

      The entity that posts tasks or events through the GigSA platform and is responsible for approving task completion and determining the compensation due to users, without creating a direct employment relationship between them.

    2. GigSA Platform

      An online platform that connects event-organizing companies with users seeking to perform temporary tasks. It facilitates task posting, acceptance, and monitoring in a manner that ensures transparency and commitment among all parties.

    3. The Platform

      The technical intermediary that enables companies and users to communicate and manage tasks in accordance with the approved terms of use, without being a party to the contractual relationship or responsible for task execution or payment.

    4. The User

      The individual who registers on the GigSA platform for the purpose of performing posted tasks. The user is responsible for complying with all stated terms and conditions, and their use of the platform constitutes implicit acceptance of these obligations.

  2. Article Two: Scope of Application
    • These terms and conditions apply to all platform users, including individuals seeking jobs and event organizers. They cover all parts of the platform, its contents, and sub-sites. Entering, registering, or using the platform in any form constitutes an explicit and direct agreement to comply with these terms and conditions.
  3. Article Three: User Obligations
    • The user agrees to the following:
    • To use the platform only for lawful purposes in accordance with the laws, regulations, and instructions applicable in the Kingdom of Saudi Arabia.
    • The user must be of legal age to enter into a contract.
    • To maintain the confidentiality of their account data and password and take full responsibility for all activities conducted using their account.
    • Not to manipulate, provide false data, or impersonate any other party.
    • To accept receiving notifications and messages from the platform regarding tasks, policies, or technical alerts.
    • Not to promote unlawful accounts or activities within the platform.
    • To refrain from repeatedly withdrawing from tasks; the platform has the right to suspend the account automatically in case of repeated withdrawals without justification.
    • Users may only perform the tasks and responsibilities associated with the role for which they have applied and been approved. Engaging in other tasks not listed in the job description is prohibited.
    • Users agree not to engage independently or directly with any event organizer met through the platform for a period of 12 months after the conclusion of the assignment without prior written consent from GigSA.
  4. Article Four: Payment Mechanism and Role Distribution
    • Financial entitlements for users will be paid after the organizing company approves the completion of the required tasks.
    • No direct employment relationship is formed between the organizing company and users; the relationship remains within the scope of technical and organizational usage.
    • All parties (users and organizers) are obligated to adhere to their designated roles and not deviate from them.
    • No payments from the app owner or any entity other than the organizing company will be accepted, and payment will only be made after the completion of work or the event and approval from the organizing company.
    • Platform owners are not allowed to take users from the scope of work assigned by the organizing company.
    • The payment amount will be based on the job applied for.
    • All financial transactions related to services rendered through the platform must be conducted exclusively through GigSA. Users are strictly prohibited from receiving any form of direct compensation from the event organizers.
  5. Article Five: Privacy and Disclosure of Information
    • The platform is committed to maintaining the privacy and confidentiality of all personal information collected from users.
    • No information will be disclosed except in the following cases:
    • Upon an official request from the competent authorities.
    • If required by law to contract or defend the rights of the platform or its users.
    • When there is suspicion of misuse or violation of laws.
  6. Article Six: Registration and Acceptance
    • The platform reserves the right to accept or reject any registration request or use without providing reasons.
    • It has the right to cancel or suspend accounts that contain false data or attempts to commit fraud.
    • The user is responsible for all activities conducted through their personal account.
  7. Article Seven: Event Management and Acceptance
    • The platform's role is limited to connecting both parties, and it does not bear any responsibility related to accepting, rejecting, or canceling individuals' participation in events.
    • Final acceptance decisions rest with the event organizer.
  8. Article Eight: User Contributions
    • All data shared by the user (comments, suggestions, questions, ratings...) becomes the property of the platform and may be used or reposted.
    • The use of fake email addresses or impersonation when applying for a job or interacting with platform content is prohibited.
  9. Article Nine: Intellectual Property Rights
    • All copyright, design, content, and programming rights are protected and exclusively owned by the platform.
    • Reposting or using any part of the platform's content without written permission is prohibited.
    • The platform is protected under intellectual property laws in force within the Kingdom of Saudi Arabia and relevant international agreements.
  10. Article Ten: Terms Update
    • The platform reserves the right to modify or update these terms and conditions at any time without prior notice.
    • Continuing to use the platform after changes have been made constitutes implicit consent to the updates.
  11. Article Eleven: General Provisions
    • The platform shall not be liable for any disputes, damages, or losses arising from the relationship between users and event organizers, except where such liability arises directly from a platform-related technical failure or breach.
    • This Agreement shall be governed by the laws of the Kingdom of Saudi Arabia. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the competent courts in Jeddah.
    • By continuing to use the platform or registering on it, you acknowledge that you have read and understood these terms and conditions and agree to fully comply with them. You also confirm that you assume all responsibilities arising from your use of the platform and interactions with other parties through it.
